Lawyer boycott can be a violation of the competition law

Øystein Foros and Erling J. Hjelmeng: The Bar Association is organizing a boycott of the Supreme Court. With that, it can itself come into conflict with the law - the competition law. The Supreme Court of the United States has stamped a similar boycott as an cartel business.

Norwegian lawyers have recently refused to take up assignments in criminal cases before the Supreme Court in protest against the public fee rates. The action is understandable, since the fee rates are very low in relation to the market price for lawyers who can bring cases in the Supreme Court, Øystein Foros and Erling J. Hjelmeng write.
